KATHMANDU: A writ petition was filed at the apex court today against the government’s decision to reshuffle responsibilities of top police officials “in breach of the election code of conduct.”
The government decision to transfer top police officials is against the code of conduct issued by the Election Commission on June 6, said Advocate Kamal Prasad Itani in his petition demanding that the court order the government to halt activities that are in violation of the code.
“If implemented, such decisions are likely to have an effect on the rights of the people and could ultimately have an irreparable impact on the fundamental rights of citizens. Therefore, the apex court’s intervention is a must,” the petitioner said.
The Cabinet decided to transfer 19 top police officials even after it declared fresh elections with the malicious intention of influencing fair and impartial elections, he added. “Since the President has already made it clear that this government is just a caretaker one, it cannot take any decision which may affect the elections.”
