KATHMANDU: Supreme Court today issued a show cause notice to the District Administration Office‚ Mahottari and the Home Ministry for denying issuing citizenship certificate to Arjun Kumar Sah.
The 24-year-old MBA student from Matihani VDC‚ Mahottari‚ had filed a writ petition at the apex court last week seeking citizenship on the basis of his mother’s nationality. Sah’s mother is a citizen by descent who works as a midwife. His father was born in India but has been living in Mahottari for the last 35 years.
Single Bench of Kalyan Shrestha issued the show cause notice against the defendants. Sah’s attorney Sunil Ranjan Singh argued in the court that Article 8(2)(B) of the Interim Constitution‚ 2007‚ stipulates that eligible persons could acquire citizenship on the basis of the nationality of his/her father or mother‚ and therefore‚ Sah was entitled to be a citizen by descent.
Singh pleaded that Sah had the option to knock the Home Ministry before filing a petition at the apex court but he did not do so because he could not enter Singha Durbar where citizenship is necessary for entering the premises. He cited SC’s verdict given in Sabina Damai’s case where the court allowed the petitioner to seek citizenship on the basis of mother’s nationality.
Sah has said his rights have been violated in the absence of citizenship certificate.
